The following Regulations define the general terms and conditions of sale applicable in our online store available at www.sklep.eurolinespa.pl, operated by GRATRANS Gracjan Kurzawski, ul. Lipowa 7, 63-714 Świnków, NIP 6211813341, REGON: 302740329.
1. Scope of application of the regulations
The Regulations apply to all orders placed by Consumers and Entrepreneurs via our online store.
A consumer is, in accordance with Article 22 of the Civil Code, a natural person who enters into a legal transaction with an entrepreneur that is not directly related to their business or professional activity.
A business is, in accordance with Article 43 of the Civil Code, a natural person, legal person and organizational unit that is not a legal person, to whom the law grants legal capacity, conducting business or professional activity in its own name.
Other or supplementary Regulations and General Terms and Conditions used by Entrepreneurs do not apply – they will become part of the contract only if we give our express written consent.
2. Conclusion of the contract
The sales agreement is concluded with GRATRANS Gracjan Kurzawski.
The presentation of products in our online store constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code. In order to submit an offer to purchase products, you must place an order. Using the mechanisms available in our store, you can add the products you have selected to the shopping cart and submit a purchase offer. The shopping cart and the data entered in the forms can be modified before placing an order, using the available functionalities and messages displayed during the ordering process.
By clicking on the button confirming and finalizing the order on the order summary page – you place an order for the products in the cart. After placing the order, you will receive an e-mail from us confirming receipt of the order and its acceptance for execution. Upon receipt of this message, the sales agreement is concluded.
3. Language and rules for consolidating the contract
The sales agreement is concluded in Polish.
We save the content of the agreement and send you the order data and our Regulations by e-mail. You can also check the information about your orders via your customer account. The Regulations are also made available on the website of our online store in a way that allows you to obtain, reproduce and save their content.
4. Product delivery
The ordered products are delivered via our transport or courier companies cooperating with us within 2-3 weeks from the payment of the deposit for the placed order. Detailed information about possible methods and dates of delivery and shipping costs are presented during the order placement and in a special information tab on our store’s website: Shipping
It is possible to collect the products in person at the following address: GRATRANS Gracjan Kurzawski, ul. Lipowa 7, 63-714 Świnków, Poland from 8:00 to 16:00.
5. Payments
The following payment methods are available in our online store:
- Payment by traditional bank transfer to our store’s bank account. If you choose this payment method – after placing your order, we will send you the transfer details via e-mail. Order processing will begin after the full amount of the required payment for the order has been credited to our account.
- Cash on delivery. Order fulfillment will begin after the required deposit payment for the order has been credited to our account.

6. Right to withdraw from the contract
In accordance with the information contained in the information on the right of withdrawal, you have a statutory right to withdraw from the contract.
7. Privacy Policy
When using the Store (consisting of registering an account, placing orders, signing up for the newsletter), the Customer provides their personal data. Providing personal data by the Customer is voluntary, but necessary to make purchases and use those services provided by the Store that require providing personal data.

By providing data, the Client declares that the personal data provided by him/her are his/her data.

8. Reservation of ownership of goods
Products ordered in the store remain our property until full payment of the sales price.
9. Damage caused during transport
For Consumers: In the case of consumer distance purchases, our shop always bears the risk of accidental damage or loss of goods during transport. If the ordered products are delivered with obvious damage caused during transport, we kindly ask you to report such a defect to the carrier as soon as possible and contact us. Delay in reporting such a complaint or contacting us has no consequences for your statutory rights (described below in the section on complaints) and their satisfaction. However, a faster report helps us to pursue our claims against the carrier or transport insurer.
10. Complaints: compliance of goods with the contract / defects
Applies to Consumers: we are obliged to deliver goods without defects. In the event of non-conformity of the goods with the contract, the Consumer has the rights specified in Chapter 5a of the Consumer Rights Act. Under the terms specified therein, the Consumer may request the repair or replacement of the goods that are not in conformity with the contract, or submit a declaration of a reduction in the price of the goods or withdraw from the contract. We are liable for the non-conformity of the goods with the contract revealed within 2 years of their delivery, unless we have specified a longer shelf life for the given goods, in which case this longer period applies.
In the event of non-conformity of the goods with the contract, the above provisions regarding the Consumer also apply to a natural person concluding a contract directly related to their business activity, when it results from the content of this contract that it is not of a professional nature for that person, resulting in particular from the subject of the business activity performed by them, made available under the provisions on the Central Register and Information on Business Activity.

Applies to Entrepreneurs: (with the exception of natural persons concluding a contract directly related to their business activity, when the content of this contract indicates that it is not of a professional nature for these persons – so-called “quasi-consumers”, i.e. sole proprietors exercising certain consumer rights): in the case of a sales contract concluded with an Entrepreneur, pursuant to Art. 558 § 1 of the Civil Code, the liability of our online store under the warranty for defects is excluded.
11. Services provided electronically
In order to use our online store, including browsing the assortment and placing orders, it is necessary to have a multimedia device with an installed web browser and access to the Internet and e-mail. It is recommended to enable JavaScript and save Cookies in the browser settings. Users are obliged to use the online store in a manner consistent with the law and good customs, and it is forbidden to provide content of an illegal nature.
We take all necessary actions to ensure the fully correct operation of the service and interface of our online store to the extent resulting from current technical knowledge and we undertake to remove all irregularities and technical problems reported by users within a reasonable time. The above also applies to the possibility of signing up to the newsletter or the optional possibility of creating a customer account – if these services are provided as part of our store. You can notify us of any detected irregularities or interruptions in the operation of the service and services of our online store using the contact details indicated in the point above. In a complaint regarding irregularities related to the technical functioning of the online store service, please indicate the type and date of the irregularity.
12. Extrajudicial dispute resolution
We inform you that Consumers have the right to use an out-of-court method of handling complaints and pursuing claims. Information on how to access the above-mentioned mode and procedures for resolving disputes can be found at the following address: www.uokik.gov.pl in the tab “Amicable resolution of consumer disputes”.
In addition, at: http://ec.europa.eu/consumers/odr Consumers have access to an online platform for resolving consumer disputes (the so-called ODR platform). The ODR platform is a multilingual, interactive website for serving Consumers and entrepreneurs seeking out-of-court resolution of disputes arising from a distance sales contract or a service contract.
The use of the above-mentioned extrajudicial methods of claim settlement and dispute resolution is voluntary and may only take place if both parties to the dispute (Consumer and seller) consent thereto.
We undertake to use out-of-court resolution of disputes with Consumers within the meaning of the provisions of the Act of 23 September 2016 on out-of-court resolution of consumer disputes. 13. Final provisions
None of the provisions of these Regulations are intended to violate the statutory rights of the Consumer. In the event of any conflict between the provisions of these Regulations and the rights of Consumers resulting from generally applicable provisions – the statutory regulations will always be applied instead of the disputed provisions of the Regulations.
In the case of Entrepreneurs, Polish law applies to all contracts concluded with us, excluding the United Nations Convention on Contracts for the International Sale of Goods.
In the case of Entrepreneurs, legal persons under public law or separate public-law entities, the court with exclusive jurisdiction to resolve all disputes arising from contractual relations between us and you will be the court with jurisdiction over our registered office. The previous sentence does not apply to natural persons concluding an agreement directly related to their business activity, when it results from the content of this agreement that it is not of a professional nature for these persons, resulting in particular from the subject of their business activity, made available under the provisions on the Central Register and Information on Business Activity.
